Everything you need to know about DIR 6 form

What is DIR 6?

eForm DIR 6 is required to be filed by a Director in case there is any change in the particular(s) as stated in DIR 3. A director having an approved Director Identification Number (DIN) is required to intimate to MCA in case of any changes in the particular(s) within a period of 30 days of any such change.

Type of changes for which DIR 6 is required:

1. Change in Director's name

2. Change in Father's name of Director

3. Change in nationality of Director

4. Change in residential status of Director

5. Change in residential address of Director

Documents required to apply for the change:

The documents required to be submitted with the DIR 6 will depend on the type of change for which DIR 6 is being filed.

1. In case of an Indian natinal, Income Tax PAN is mandatory in all cases, irrecpective of the change. Even if there is no change in the PAN, then also PAN is required. In case the details like, name/ father's name/ date of birth are incorrect in the PAN, then it is advised to first correct the details in the PAN and then file DIR 6.

2. In case of a foreign national, passport is a mandatory requirement.

3. It is mandatory to enter a valid email id and mobille number in all cases.

4. Photograph: It is mandatory to upload a latest passport size photograph in case there is a change in the photograph.

5. Name change: If name is to be corrected, then enter the full correct name in the specified coloum for first name, middle name and last name. It is mandatory to enter the same name (including spelling) as in the identity proof in case there is a change in the name of the applicant. No prefix / suffix like Mr./ Ms./ Kumari/ Shri/ Late/ Ji etc. are to be used. In case the details as per PAN are incorrect then it is advised to get the PAN corrected first.

6. Father's name change: If father's name is to be corrected then enter the full correct name in the specified coloum for first name, middle name and last name. It is mandatory to enter the same name (including spelling) as in the identity proof in case there is a change in the father's name of the applicant. No prefix / suffix like Mr./ Ms./ Kumari/ Shri/ Late/ Ji etc. are to be used. In case the details as per PAN are incorrect then it is advised to get the PAN corrected first.

7. Residential Address: In case the residential address is to be updated, then enter the exact address matching with the residence proof. Address proof like utility bill, electricity bill, bank statement, telephone bill, etc. shall be attached. In case of an Indian Director, the document should not be older than 2 months from the date of filling the DIR 6. In case of a foreign director, the document should not be older than 1 year from the date of filling the form.

8. In case the proofs are in a language other than Hindi/ English then a professional translator is required to translate the proofs in Hindi/ English. The name, signature, address and seal of the transaltor should be clearly visible.

9. Any other information can be provided as optional attachment(s).

Steps to submit the form:

1. Open the MCA portal.

2. Select the DIR 6 form under MCA Services> Company e-Filing> DIN Related Forms> DIR 6- Change in particulars of Director.

3. Write the DIN number and name of the Director will auto fill.

4. Select the 'type of change' as required.

5. Enter the PAN number and click on 'verify Income tax PAN'. The name, father's name and date of birth will be verified by the system from the income tax PAN details.

6. Upload the relevant document keeping in mind the size of the document that can be uploaded.

7. Click on next.

8. Verify the details and after declaration click on submit.

9. Download the filed form from the portal and attach the digital signature of the applicant.

10. The form is also required to be digitally signed by a certified Chartered Accountant (in whole-time practice) or a Cost Accountant (in whole-time practice) or a Company Secretary (in whole-time practice).

11. After appropriate certificate, upload the form in the MCA portal.

After successful submission of the form, SRN will be generated which can be used for any future correspondence with MCA.
